Dear Councilman Griffin, Mr. Epstein and Ms. Huang,

I am writing to express my shock and concern at the manner with which the Board of Zoning Appeals (BOZA) on March 21, 2022 reached its decision to deny a request for rehearing / reconsideration by the Hessler Community regarding the zoning variances recently granted by BOZA for development on Hessler Street and Ford Road.

The Hessler Community painstakingly detailed new information that had recently come to light that was material, significant and fundamentally altered the basis for the original BOZA decisions in this case.

Yet, in what could reasonably be construed to be a decision that appeared arbitrary, capricious and an abuse of discretion, without any factual explanation the BOZA unanimously denied the request.

Factually there clearly was new information affecting the underlying decision-making in the case to date, and the abrupt and rationale-absent manner in which the BOZA decision was formulated and delivered on March 21 left no opportunity for the representatives of the Hessler Community to even request an explanation from the BOZA of the factual basis for the decision.

I strongly suggest you evaluate the detailed information provided by the Hessler Community to the BOZA for this meeting and then watch the video of the perfunctory, dismissive and entirely unsupported manner in which the matter was “adjudicated.”

The manner in which the decision was reached by BOZA should be evaluated to determine if it constituted malfeasance, and I respectfully request that you intervene to determine if the rights of the Hessler Community have been abridged by the failure of BOZA to follow its statutory and regulatory obligations in this decision.
